Originally passed in 1987, the law now called the McKinney-Vento HomelessAssistance Act presents a number of legal requirements for how schools handletheir unhoused students. The McKinney-Vento Act contains numerous provisions aimed at helping reducethe problems of homelessness in America, and not all of them are aimed atschools. However, there are several obligations placed specifically on schools,and failing to adhere to them could risk your Federal funding!
Among other key points:
- Homeless students cannot be singled out or segregated.
- Homeless students must receive the same school services as everyone else.
- Homeless students residing in or near a district must be admitted, even if they lack some normally-necessary documentation.
- Homeless students must receive school transportation services.
- Homeless students automatically qualify for meal assistance.
- Homeless students have a right to privacy, and if necessary, buses should drop them off in a place which does not reveal their unhoused status.
In addition, schools are required to have a staff member designated as ahomeless education liaison, responsible for handling these matters and ensuringthe unhoused students' rights are upheld. Transportation administrators mayneed to coordinate with this liaison, such as determining the best homelessstudent routing on buses.
Taken together, these measures make it less likely that homeless studentswill 'fall through the cracks' or end up in a hopeless situation with noeducation. However, the requirements are numerous, and sometimes complicated.
